The AAA is the leading arbitration<br \/>\norganization in the country, and I\u2019ve been honored to be included on its<br \/>\npanel. The AAA only selects a small percentage of lawyers for this<br \/>\ndistinction, and they must undergo an involved application process and<br \/>\ntraining.<br \/>\nAs an arbitrator, I have presided over arbitration hearings, made<br \/>\nevidentiary determinations, interpreted contracts, and applied the law<br \/>\njust like a judge would do. In two cases, my co-arbitrators appointed me<br \/>\nchair of the cases involving a three-arbitrator panel, which was a<br \/>\ndistinct honor. My arbitration background, experience, and training will<br \/>\nprove very helpful if I\u2019m elected to serve the people of Hamilton County<br \/>\nas an appellate judge.<\/p>\n<p><strong>(2) What about your non-judicial legal experience qualifies you to be a<\/strong><br \/>\n<strong>judge?<\/strong><br \/>\nMy experience as an appellate lawyer handling over 100 appeals in my<br \/>\ncareer makes me uniquely qualified to both serve on the bench and to<br \/>\nhelp accomplish the change that is needed to make our Court a shining<br \/>\nlight in the State. I come from a background of public service\u2013my father<br \/>\ntaught history, my mother was an Episcopal priest, one brother is a<br \/>\njudge in Kentucky, and my other brother is a naval officer serving at the<br \/>\nPentagon. I am ready to take those lessons I have learned, both growing<br \/>\nup and as a lawyer, to serve the residents of Hamilton County. I<br \/>\ngraduated from the University of Virginia School of Law, and<br \/>\nsubsequently served as a law clerk for Judge David Nelson of the Sixth<br \/>\nCircuit Court of Appeals in Cincinnati. I then joined the law \u00d7rm of<br \/>\nSquire Patton Boggs and became the Chair of the Appellate and<br \/>\nSupreme Court Practice Group.<br \/>\nIn that capacity, I have argued appeals in federal and state appellate<br \/>\ncourts across the country, including twice at the United States Supreme<br \/>\nCourt. As a recognized leader in appellate practice, I was recently named<br \/>\nCincinnati\u2019s Appellate Lawyer of the Year by Best Lawyers, as selected<br \/>\nby my peers. Judges have frequently named me to serve on court related<br \/>\ncommittees, such as rule advisory committees, providing me a<br \/>\nchance to work closely with judges and have a voice on how the court\u2019s<br \/>\nprocedures can be improved. Judges have also invited me to speak at<br \/>\njudicial conferences on topics of appellate practice. I have taught at<br \/>\nnumerous lawyer-training programs throughout Ohio, generally on<br \/>\nappellate practice, and I have published articles on those topics. I<br \/>\nenjoyed the opportunity to teach at the University of Cincinnati<br \/>\nCollege of Law, where I founded the Appellate Litigation Clinic to allow<br \/>\nlaw students the opportunity to assist in representing indigent clients.<br \/>\nBeyond my civil litigation experience, I have won pro bono cases for<br \/>\nindigent criminal defendants at the Ohio Supreme Court, the Kentucky<br \/>\nSupreme Court, and the Sixth Circuit Court of Appeals. I have also<br \/>\nworked on several appeals with the Ohio Innocence Project, including<br \/>\ntwo cases that led to the exoneration of innocent men who collectively<br \/>\nserved decades in prison. These experiences have granted me a deep<br \/>\nunderstanding of the challenges facing our criminal justice system.<\/p>\n<p><strong>(3) Why are you running for this particular court seat?<\/strong><br \/>\nI have practiced nearly 20 years in appellate courts across the country,<br \/>\nincluding Ohio\u2019s First District Court of Appeals. This experience has<br \/>\nshown me what works and what doesn\u2019t in appellate courts. I am<br \/>\nrunning for this seat because I believe that I can help bring positive<br \/>\nchange in the First District, making the court both more transparent<br \/>\nand responsive to the citizens of Hamilton County. Specifically, there<br \/>\nare two changes that will help render the appellate process fairer to the<br \/>\nparties appearing before the Court.<br \/>\nFirst, the First District has a long-standing rule (not present in any<br \/>\nother Ohio appellate district) that places restrictions on the briefs that<br \/>\nparties submit. Changing this rule will enable the parties to fully<br \/>\ndevelop the arguments that they wish the Court to consider\u2013in other<br \/>\nwords, their voices should be heard. More developed briefings will<br \/>\nassist the judges in reaching the correct decision by allowing a full<br \/>\nconsideration of the matter before court. We should therefore bring<br \/>\nthe First District\u2019s rules in line with what all of the other appellate<br \/>\ndistricts in the State do.<br \/>\nSecond, a substantial percentage of the Court\u2019s decisions have<br \/>\nhistorically been rendered with 2-3 page judgment entries. These<br \/>\nentries often do not provide much analysis of the issues on appeal,<br \/>\noften leaving the parties in the dark as to why the Court reached its<br \/>\ndecision. Win or lose, a party deserves a complete explanation for the<br \/>\nCourt\u2019s decision so that it knows that the Court seriously considered its<br \/>\ncase. Providing a more thorough analysis will also help lawyers and<br \/>\ntheir future clients to understand the law governing this district, and<br \/>\nthis increased transparency will help instill a greater confidence in our<br \/>\njudiciary. Nearly all the clients I\u2019ve represented over the years believe<br \/>\nthat their case is the most important matter before the Court. And they<br \/>\nare uniformly disappointed if the Court does not show them that<br \/>\nrespect. The First District is effectively the Supreme Court for<br \/>\nHamilton County (because so few cases can be appealed further), and<br \/>\nits rulings greatly affect the lives and businesses of Hamilton County<br \/>\nresidents.
