We\u2019ve had both a productive end to 2025 and start to 2026.<\/p>\n
IPPI hosted our final meeting of the 2025-2026 Edison Fellowship<\/a> in January, and Fellows are starting to submit papers for publication. We also accepted our next round of Fellows, gathered for our first meeting in March, and look forward to seeing how those papers progress.<\/p>\n We hosted our High Tech, virtual Copyright, and in-person Copyright Roundtables, continuing to bring scholars and industry professionals together to discuss key issues. In February, we held our first IPPI Winter Institute<\/a>; some details on that are below, and panel videos will be available on our YouTube channel<\/a> soon, with transcripts to be published in the Akron Law Review<\/a> later this year.<\/p>\n Additionally, we formed a High Tech and a BioPharma Scholars Council, each of which will meet quarterly, and we had our first meeting of the Steering Committee for the Stevens Roundtable on Life Sciences Innovation. All three groups bring academics and industry experts together for lively discussions. We have several interesting projects on the way; look for details in upcoming progress reports and other email communications from IPPI.<\/p>\n I am happy to share that the next iteration of the virtual WIPO-U.S. Summer School on IP is coming together, and we are looking forward to hosting a great group of national and international students. See IPPI\u2019s WIPO-U.S. Summer School webpage<\/a> for more details.<\/p>\n Best regards,<\/p>\n These are events either hosted or co-hosted by the members of the IPPI team and our affiliates from December 2025 through February 2026.<\/p>\n On December 2, IPPI hosted a roundtable on \u201cIntellectual Property and High Tech Policy\u201d at the Covington & Burling LLP Washington, D.C. office. Participants discussed topics including litigation leadership, IP and antitrust, and licensing.<\/p>\n On December 10, IPPI hosted a small virtual roundtable on \u201cThe Future of the Copyright Office in the Age of AI\u201d to discuss a wider view about what the Office should look like and how it should function to meet the needs of creators.<\/p>\n On January 15-16, IPPI hosted the virtual third and final meeting of the 2025-2026 Thomas Edison Innovation Law and Policy Fellowship. The Edison Fellows presented substantially revised drafts of their research papers and received feedback from Distinguished Commentators and other Fellows before submission to journals.<\/p>\n On January 21, IPPI hosted the first meeting of the newly formed IPPI Steering Committee.<\/p>\n On January 29, IPPI hosted the first meeting of the Steering Committee for the Stevens Roundtable on Life Sciences Innovation.<\/p>\n The IPPI 2026 Winter Institute: IP and National Success<\/em><\/a> was hosted in Lake Buena Vista, FL, on February 26 in partnership with The University of Akron\u2019s Winter Institute 2026<\/a>. The conference brought together leading scholars and industry experts to examine why effective IP rights and complementary public policies are essential to American innovation leadership, analyze what has driven success in key sectors, and chart a path to maintain or reclaim America\u2019s position as home to the world\u2019s leading creator and innovators.\u00a0<\/strong><\/p>\n On February 27, IPPI hosted a roundtable entitled \u201cAn Unhurried View of the Future of Copyright\u201d (a name and theme inspired by American copyright scholar Professor Benjamin Kaplan<\/strong>) in Lake Buena Vista, FL, bringing together academics and industry practitioners to zoom out and take an unhurried look at copyright law, policy, and administrative structure for the future.<\/p>\n These are news and speaking engagements for the members of the IPPI team and our affiliates from December 2025 through February 2026.<\/p>\n IPPI Senior Scholar\u00a0Ted Sichelman<\/strong> submitted “Amici Curiae<\/em> Brief of Intellectual Property and Innovation Scholars in Support of Petitioner<\/a>” in Lynk Labs, Inc. v. Samsung Electronics Company, Ltd. et al<\/em> on December 3.<\/strong> The brief was also signed by IPPI Associate Faculty Chair, Senior Fellow for Life Sciences, & Senior Scholar Emily Michiko Morris<\/strong>; IPPI Research Professor and Executive Director\u00a0Joshua Kresh<\/strong>; and IPPI Faculty Chair & Senior Scholar\u00a0Mark Schultz<\/strong>.<\/p>\n A 2024 amicus brief<\/a> filed by tattoo artists represented by Professor Sandra Aistars<\/strong> and her former Arts & Entertainment Advocacy Clinic in support of photographer Jeff Sedlik<\/strong> in Sedlik v. Von Drachenberg<\/em> was cited favorably in a concurring opinion<\/a> by Judges Anthony D. Johnstone <\/strong>and Kim McLane Wardlaw<\/strong> of the Ninth Circuit. Although Mr. Sedlik was not successful in his appeal, two of the three judges on the panel joined in the concurrence which harshly criticizes the 9th Circuit’s intrinsic\/extrinsic test for substantial similarity. This suggests a potential avenue to overturn the long-controversial infringement test.\u00a0<\/p>\n In December, IPPI Senior Economist Alexander Raskovich<\/strong> and IPPI Scholar Dr. Amy Semet<\/strong> filed responses to the USPTO’s Notice of Proposed Rulemaking (NPRM) on Revised Rules of Practice before the Patent Trial and Appeal Board (PTAB). The USPTO proposed significant changes to the IPR process, and, as academics, IPPI felt that it would be helpful to provide some details that should be considered as changes are made. We are particularly excited to see some additional publications (forthcoming) from Dr. Semet that will share more on the PTAB dataset she has spent the last several years compiling.
