And, since even a pandemic can\u2019t keep the world from having a busy back-to-school month, I\u2019ll keep this month\u2019s note short.<\/p>\n<p style=\"text-align: justify\">First, we\u2019re gearing up for <a href=\"https:\/\/cip2.gmu.edu\/the-evolving-music-ecosystem\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>The Evolving Music Ecosystem<\/em><\/a> conference on September 9-11, 2020. The conference will be held via Zoom and feature a keynote address by singer, songwriter, and author <strong>Rosanne Cash<\/strong>. Registration <a href=\"https:\/\/cip2.gmu.edu\/the-evolving-music-ecosystem\/\" target=\"_blank\" rel=\"noopener noreferrer\">is still open<\/a>, and we hope you\u2019ll join us!<\/p>\n<p style=\"text-align: justify\">Second, I\u2019d like to welcome University of Missouri-Kansas City School of Law Professor <strong>Chris Holman<\/strong> as CPIP\u2019s new <a href=\"https:\/\/cip2.gmu.edu\/about\/our-team\/chris-holman\/\" target=\"_blank\" rel=\"noopener noreferrer\">Senior Fellow for Life Sciences<\/a>. He will be taking over the role from Professor <strong>Erika Lietzan<\/strong> of University of Missouri School of Law, who has been supporting CPIP in that capacity for the past year. (Clearly, we have an affinity for the Show-Me State!) This year\u2019s theme is <em>5G at the Nexus of IP, Antitrust, and Technology Leadership<\/em>.<\/p>\n<p style=\"text-align: justify\">In other news, CPIP Senior Fellow for Innovation Policy <strong>Jonathan Barnett<\/strong> <a href=\"https:\/\/truthonthemarket.com\/2020\/08\/25\/introducing-totms-newest-blogger-professor-jonathan-m-barnett\/\" target=\"_blank\" rel=\"noopener noreferrer\">is now blogging<\/a> at Truth on the Market, a platform for academics and economists to discuss various aspects of business law. Rev. Franklin Pierce Center for Intell. Prop. 104 (2020)<\/p>\n<p style=\"text-align: justify\">CPIP Senior Scholar <strong>Kristen Osenga<\/strong> has published a new paper on patent-eligible subject matter at IDEA entitled <a href=\"https:\/\/law.unh.edu\/sites\/default\/files\/media\/2020\/06\/patent-eligile_subject_matter._still_wielding_the_wrong_weapons-12_years_later_by_kristen_osenga.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Patent-Eligible Subject Matter\u2026 Still Wielding the Wrong Weapon\u201312 Years Later<\/em><\/a>. The paper looks at changes to patent eligibility that have developed since Prof. Osenga published an <a href=\"https:\/\/scholarship.richmond.edu\/law-faculty-publications\/459\/\" target=\"_blank\" rel=\"noopener noreferrer\">article on the same subject<\/a> in 2007. At the time, she concluded that the Patent Office was using the \u201celephant gun\u201d of new guidelines on the \u201cants\u201d of patent eligibility. In the new paper, Prof. Osenga traverses the Supreme Court\u2019s subsequent Section 101 decisions that drove the courts and Patent Office to continue wielding an \u201coutsized elephant gun\u201d when it comes to patent eligibility. However, she does note that recent activities at the Patent Office and Congress offer some hope that things may be changing for the better.<\/p>\n<p style=\"text-align: justify\"><strong>Mark F. Schultz<\/strong>, <a href=\"https:\/\/static1.squarespace.com\/static\/5746149f86db43995675b6bb\/t\/5f2829980ddf0c536e7132a4\/1596467617939\/USIJ+Full+Report_Final_2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><em>The Importance of an Effective and Reliable Patent System to Investment in Critical Technologies<\/em><\/a> (USIJ July 2020)<\/p>\n<p style=\"text-align: justify\">Venture capitalists pouring money into a small startup has become a sort of new American Dream for many innovators. The success stories of big American companies starting with nothing more than an idea have pervaded their way into pop culture, inspiring TV shows, movies, and the like. However, CPIP Senior Scholar <strong>Mark Schultz<\/strong> has released a new report for USIJ entitled <a href=\"https:\/\/static1.squarespace.com\/static\/5746149f86db43995675b6bb\/t\/5f2829980ddf0c536e7132a4\/1596467617939\/USIJ+Full+Report_Final_2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><em>The Importance of an Effective and Reliable Patent System to Investment in Critical Technologies<\/em><\/a> showing that this dream may be harder to attain today due to recent shifts that have weakened the patent system and driven away venture capital investment. The panel focused on explaining key concepts of copyright law pertinent to visual artists and sharing resources that they can use to learn more about the basics of copyright protection. It also touched on common pitfalls among visual artists when it comes to protecting their creative works, including those that befall joint authors, and common misconceptions about fair use. Our blog post summarizing the event is available <a href=\"https:\/\/cip2.gmu.edu\/2020\/08\/11\/cpips-sandra-aistars-joins-artomatic-panel-on-copyright-protection-for-visual-artists\/\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>.<\/p>\n<p style=\"text-align: justify\">On August 25, 2020, CPIP Senior Fellow for Innovation Policy <strong>Jonathan Barnett<\/strong> published a new essay at Truth on the Market entitled <a href=\"https:\/\/truthonthemarket.com\/2020\/08\/25\/will-montesquieu-rescue-antitrust\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Will Montesquieu Rescue Antitrust?<\/em><\/a> In the post, Prof. Barnett examines recent pressure on state and federal regulators to use antitrust laws against firms that have established market dominance, and he praises the genius of the eighteenth-century philosopher Montesquieu for developing the theory of separation of powers that allows the judiciary to police overly zealous antitrust prosecutors today. Traversing recent\u2014and failed\u2014antitrust enforcement actions, including AT&amp;T\u2019s acquisition of Time-Warner, Sabre\u2019s acquisition of Farelogix, and <em>FTC v. Qualcomm<\/em>, Prof. Barnett explains how the judicial branch has become an important counterbalance to prosecutorial antitrust overreach that betrays the fundamental objective of promoting the public interest in deterring anticompetitive business practices.<\/p>\n<p style=\"text-align: justify\">On August 25, 2020, CPIP Senior Scholar <strong>Kristen Osenga<\/strong> published an op-ed in the Washington Times entitled <a href=\"https:\/\/www.washingtontimes.com\/news\/2020\/aug\/25\/if-we-want-innovation-companies-must-be-able-to-re\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>If We Want Innovation, Companies Must Be Able To Rely on Patent Law To Protect Their Investments<\/em><\/a>. The op-ed explains the importance of effective patent protection for innovative companies to develop and commercialize their new technologies. In particular, Prof. Osenga praises the recent antitrust victory of Qualcomm over the FTC in the Ninth Circuit, noting that a \u201crace that results in innovation that other companies, and the public, dearly desires is exactly the point of competition.\u201d Prof. Osenga also authored a recent op-ed for the Richmond Times-Dispatch, <a href=\"https:\/\/richmond.com\/opinion\/columnists\/kristen-osenga-column-with-biomedical-research-taxpayers-are-getting-a-great-deal\/article_48773ccd-166a-53a1-b376-39be709b80d6.html\" target=\"_blank\" rel=\"noopener noreferrer\"><em>With Biomedical Research, Taxpayers Are Getting a Great Deal<\/em><\/a>, explaining how the critics are wrong to argue that the government should take control of important biomedical inventions like remdesivir.
