Greetings from IPPI Research Professor & Executive Director Joshua Kresh
This has been another productive summer for IPPI. We ran the 2026 WIPO-U.S. Summer School on Intellectual Property, which drew participants from more than fifteen countries and included the virtual panel “IP at America’s 250th,” co-hosted with C4IP. We were also active in the policy space with a letter before the U.S. Senate Judiciary Committee in support of the Patent Eligibility Restoration Act (PERA), for which IPPI Advisory Board Member the Hon. Andrei Iancu also testified; in a comment to the Office of Management and Budget; and in a letter to the Senate HELP Committee on the Medication Affordability and Patent Integrity Act.
Our scholars were also active over the summer. IPPI-affiliated researchers published new work on pharmaceutical patents, AI patent litigation, FRAND licensing, trade secrets, copyright, and the evolving role of IP in technology ecosystems, including two newly published Edison Fellowship papers by former Fellows Matthew Sipe and Dr. Andrew Vassallo, as well as current Edison Fellow David Atkinson‘s new book from Cambridge University Press on generative AI and the law. Our scholars presented at leading venues around the world, from São Paulo to Dublin to Stanford, and were quoted widely in outlets ranging from Bloomberg Law to Al Jazeera to the Washington Examiner.
Moving into the final months of 2026, we held our second meeting of this year’s Edison Fellowship just this past week (more to come on those papers later), and we will be announcing the next round (2027-2028) of Edison applications soon. Also, I hope you will join us for our next public event: On Wednesday, October 7, we will host a webinar on “The Future of Copyright’s Substantial Similarity Doctrine: Insights from the En Banc Rehearing in Sedlik v. Von Drachenberg,” in which council and amici participating in the case will analyze the Ninth Circuit’s en banc hearing shortly after the September 29 oral argument. WIPO-U.S. Summer School on Intellectual Property (Online)
From June 1-12, IPPI partnered with the World Intellectual Property Organization for the virtual 2026 WIPO-U.S. Summer School on Intellectual Property. WIPO’s only U.S.-based Summer School, this annual program is a two-week, online course focusing on IP law in the United States and consisting of lectures, case studies, simulation exercises, and group discussions on selected IP topics, with an orientation towards the interface between IP and other disciplines. This year, we were joined by law students, professionals, and other students of IP from Brazil, Canada, China, Ghana, India, Latvia, Malawi, Mexico, Nepal, Pakistan, the Philippines, Poland, Saudia Arabia, Slovakia, Sri Lanka, Ukraine, and the United States. Many thanks to all our instructors, students, and partners for another successful program!

Virtual Panel on “IP at America’s 250th,” Co-Hosted with C4IP
America was born innovative. The Founders embedded intellectual property protection directly into the Constitution, and for 250 years the nation’s patent, copyright, trademark, and trade secret laws have powered everything from the cotton gin to the smartphone, and from the first American novel to the global entertainment industry.
On June 10, IPPI and the Council for Innovation Promotion (C4IP) co-hosted a virtual panel to mark America’s 250th anniversary by telling the story of IP from the ground up. Moderated by IPPI’s Joshua Kresh, the panel featured speakers Victoria A. Cundiff (Adjunct Professor, University of Pennsylvania Carey Law School; Former Partner, Paul Hastings), David Gooder (Senior Advisor, The International Trademark Association (INTA); Former Commissioner for Trademarks, USPTO), the Hon. Andrei Iancu (Co-Head of Intellectual Property and Technology Litigation Group, Sullivan & Cromwell LLP; Former Undersecretary of Commerce for Intellectual Property and Director, USPTO; Co-Chair, Council for Innovation Promotion (C4IP)), and Karyn A. Temple (Senior Executive Vice President and Global General Counsel, Motion Picture Association (MPA); Former Register of Copyrights, U.S. Copyright Office). The panel was also a part of the 2026 WIPO-U.S. Summer School on IP.
Virtual Panel on “The Myths and Realities of Pharmaceutical Patents”
In an exclusive June 18 webinar, IPPI scholars examined the myths and realities of pharmaceutical patents. The conversation featured IPPI’s Mark Schultz and Emily Michiko Morris and was moderated by Chris Israel, Executive Director of the Alliance of U.S. Startups & Inventors for Jobs (USIJ). In the wake of the June 4 House Judiciary Committee hearing on “Medicines and IP: Balancing Innovation and Access,” the panel unpacked prevailing narratives surrounding pharmaceutical patenting, innovation, and generic competition. Drawing on new IPPI research on so-called “patent thickets” and “evergreening,” the discussion examined how pharmaceutical patents reflect the complex, ongoing process of developing and improving medicines — and why simplistic patent counting and common critiques of pharmaceutical patenting often fail to align with real-world evidence.
