In May 2016 I was appointed as the sole Magistrate for the Williams County Common Pleas Court, all divisions. In this position my docket includes the following cases: domestic relations/family law cases, civil protection cases, settlement conferences in civil cases, paternity cases, and all child support cases. I also hear cases on each Judge’s docket in all divisions, as well as the specialized dockets, when a Judge is not available. This has provided me with a wide range of experience in all divisions of the Court.

Prior to being appointed as the Magistrate for the Williams County Common Pleas Court, I was in private practice for 30 years. I was a partner in the general practice firm of Gallagher & Gallagher, LTD, located in Bryan, Ohio. I regularly appeared in the Court’s of Northwest Ohio, representing client’s in a wide variety of cases. I have represented clients in the type of cases that are regularly heard in the Probate and Juvenile divisions of the Court.

The legal experience that I have, combined with my responsibilities as Magistrate, have instilled in me a thorough understanding of the law and the temperament needed for this position.

(3) Why are you running for this particular court seat?
I have lived in the Williams County community for over 34 years. My entire legal career has been in this community representing clients in our County and surrounding Counties. We raised our son here. This is my home. From the moment I moved here I have been active in most every aspect of this community. I was brought up to believe that it is our civic duty to be involved and make a difference in the community where we live and work.

Over the years I have seen changes. I see solutions for the changes that are occurring through a different lens then others. I want to do all I can to make the Court accessible, to continue to create a collaborative effort between the schools and agencies in our community and help families and youth who are struggling. There is still much that needs to be done in these changing times. I want to apply the skills that I have to meet the challenges that face the people in our County.

I was an assistant prosecuting attorney for 14 years before I was appointed to serve as a Magistrate in the Court where I seek office. I litigated over 70 felony trials, including but not limited to cases involving felony sexual assault, murder, death penalty litigation, domestic violence and economic crime. I supervised the litigation and trial preparation for junior prosecutors. I frequently argued before the Court of Appeals on a wide variety of Appellate issues.

Prior to my appointment as a Magistrate in Domestic Relations Court, I had a very strong litigation background which is essential for judicial officers, who regularly preside over trials. I practiced in both the Common Pleas Court appearing in front of 34 different Judges with unique styles as well as the Court of Appeals. I wrote all of my own appellate briefs and argued in the Court of Appeals frequently, which is an excellent way for practicing attorneys to hone their research and writing skills. These skills are vital for judicial officers.
Finally, for the past 20 years I have been invited to lecture at Continuing Legal Education Trainings where I have had the opportunity to train other attorneys on a variety of topics including Domestic Violence Criminal Protection Orders, Marriage Equality and Judicial Case Management.

(3) Why are you running for this particular court seat?
I currently serve as a Magistrate in the court where I seek office. I love the work that I do. I am highly qualified, experienced and fair and have unmatched judicial experience in this race. Every single day I work to positively impact the children and families who come to my court in crisis. I understand what we do well as a court and the ways that we can improve our court so that all of the families in our vast and diverse community have access to justice and are treated with dignity and respect. I believe I have a good judicial temperament which I work on daily. I know the law and I strive to enforce it evenly and in a thoughtful manner. I work on various committees within the Domestic Relations Court in order to improve processes and to ensure that our families and children leave our court with a plan to succeed in their often challenging new life.

Outside of work, I enjoy spending time with my own family and volunteering on various charitable interests. I care deeply about my community and the families that come to me for solutions. Most importantly, I do my job with compassion and heart which are qualities that we should expect from all public servants.

I have worked in Morgan County as a lawyer for the past 26 years. As an attorney I have handled all the types of cases that will be heard by the next Common Pleas Judge including civil, criminal, juvenile and probate matters. For many years I was a successful criminal defense lawyer, winning the majority of the cases I tried. For the past 5 years, I have served as an Assistant Prosecuting Attorney primarily handling felony cases. I have successfully prosecuted assaults, rapes, drug dealing and a bank robbery. I am the only candidate running for Judge with any significant felony prosecution experience. In addition, I currently serve as legal counsel for the Villages of Chesterhill and Malta.

In the past, I also represented both McConnelsville and Stockport. My private law practice has evolved over the years. Early on I handled a lot of juvenile, criminal and divorce cases. Today most of my work is real estate, oil and gas, estates, adoptions, guardianships, wills and general advice. I have experience with all the matters that your next Common Pleas job must oversee. Further, since 1994 I have been a leader and volunteer in the community with a track record of success.

I have served as President of the Chamber of Commerce, Mayor of McConnelsville, Board member of the Community Improvement Corporation, and a founder and director of the Morgan Community Fund. The Court is the next best place for me to serve the community and I look forward to the opportunity. I believe the purpose of government is to secure our God given rights. Thomas Jefferson wrote in the Declaration of Independence “that all men are created equal, that they are endowed by their Creator with certain unalienable Rights ¦ that to secure these rights, Governments are instituted among Men.” As Judge it will be my duty to protect your rights to life, liberty and property as well as those specific rights set forth in the Constitution. I intend to fulfill that duty. A Judge needs to be fair and impartial. I am slow to anger, plain speaking, and compassionate but at the same time I am capable of being firm and consistent. I believe I have the temperament and disposition to remain calm in stressful situations and to render evenhanded and impartial rulings. Being your Judge will be the honor of my life but it also will be the greatest burden I have ever accepted. I do not take it lightly. Heart wrenching cases will come before me. I will render life altering decisions. Custody, divorce, child abuse are the type of cases that must be dealt with daily. Each case has the potential of keeping one up all night. (3) Why are you running for this particular court seat?
I believe the position should be reserved for people that have practiced in the courtroom for several years. I have tried and litigated hundreds of cases and managed hundreds of lawyers. I understand the law and procedures of the courtroom and can help lawyer’s resolve conflicts and ensure defendants’ rights are protected. Secondly, I believe that the decision should not be taken lightly and that it should be a vocation. I do believe that I can help parties resolve conflicts, and that my knowledge of the docket, courtroom procedures and decisions will be helpful to all lawyers and parties that have to come before a court of law. It is because I believe I can serve that I wish to become a Judge of the Common Pleas Court. The court should address the bond disparity (referred to as Bail Reform), the Justice Center building plans, and Centralized booking with Drug treatment and mental health centers to triage people. I have provided my input to the Administrative Judge and have specific suggestions on how this can be accomplished. I am also very interested in the recent Sentencing Commission call for a Sentencing database. I believe transparency is important and will promote the statutory obligations of the court that sentences should be structured to rehabilitate the offender, protect the safety of the community and do so with the least expense of resources. The statute also says sentences should be consistent with each other. Sentences should be proportional and consistent. I believe a sentencing database will have an impact on the levels of incarcerated defendants by limiting sentences that are disproportionate. I will keep a transparent record of my sentencings and encourage the practice. I believe that a research partner should be utilized to assist with the development of a data system that has the scope to track sentences by charge, victim and defendant information and fact patterns.

I am passionate about pro-life choices. As the Probate Court Judge I can educate and offer adoption over abortion. I also deeply care about our elderly and disabled population. The guardianship program in Butler County is one of the top in the nation due to retaining a court investigator and team of experts to assist the guardians and wards as issues arise. Butler County Probate Court is a national leader in the mental health and civil commitment process. It is important for our community to assist individuals with mental illness to maintain a productive lifestyle outside of civil commitment or prison.

Butler County Probate Court is also on the forefront of civil assistance with abuse and dependency issues and treatment. As Probate Judge, it is important to allow people the ability to fight addiction. I feel it is of the utmost importance for people to have a voice and want to continue to educate the population regarding completing their health care directives and legal documents.

I have dedicated my career to public service, including 15 years as a magistrate in Butler County. I am committed to people and their Constitutional Rights. For 22 years prior to taking the bench I maintained a diverse private practice, wherein I honed my craft. I diligently represented thousands of clients in the areas of Civil litigation, Criminal, Domestic Relations, Juvenile, Probate Law and Estate Planning. I managed several great employees. Collectively payroll was made via hard work, leveraging technology and maximizing productivity. My experience allowed me to fully comprehend the tasks of attorneys and the pressures parties involved by those involved in legal matters. I was born and raised in Medina, know the area intimately, and much of its populace. I was raised to care and treat with others with respect. I stood beside people struggling at their lowest ebb and acted as their voice. Based upon the experiences in my career I was certified by the Ohio Supreme Court to try Capital Cases (Death Penalty) and represented three such individuals. I had tried numerous other cases, both civil and criminal, before courts and juries throughout the State.

Later as a Prosecutor for the City of Medina I wore a different hat, but always focused on maintaining the integrity of the law. In each role I have experienced the anguish of victims, the fear of the court system, misunderstandings, and emotions that often overcome those who come to court. As an attorney I worked hand in hand with experts in numerous areas, learned medical and psychological terminology, read extensively, and understood the operation and standards of care in numerous fields. Serving on jury duty taught me to consciously strive to present issues with clarity and insight, both in one’s writings and in presentations. During my career as an attorney I wrote numerous pleadings and briefs on diverse areas of law and countless contracts, wills, trusts and the like.

Ultimately my best legal experience was working with and for people. I relished the role of a Guardian ad Litem, advocating to ensure that children’s best interests bee presented to the Court. I also was privileged to be appointed as Guardian over individuals who had been deemed incapable of tending to their affairs. Ensuring the safety of the most delicate and fragile individuals taught me humility. I learned it was easy to work hard for the people behind the pleadings, to ensure their needs were met and to pay it forward.

(3) Why are you running for this particular court seat?
I am experienced, caring, and effective in providing positive community impact. Over seven years I have presided over this court which handled over 6500 Juvenile matters and over 6000 Probate matters. I personally heard every Abused/Neglected child case during the height of the Heroin epidemic. I ensured our children were kept safe. I required no training wheels when I assumed the position, nor do I duck “hard” cases. I have heard matters involving disputes over 100 million dollar estates/trusts one day and murder charges the next. I make tough decisions daily, am passionate about my job and I am devoted to my community and its people. Our Certified Drug Court has graduated 175 kids since 2015. Drug Court is critical to keep kids off drugs and to break the cycle of drug abuse into adulthood.

I plan to develop additional evidenced based practices such as our Teen Intervention 180. TI-180 has been recognized by the Ohio Supreme Court for excellence in diversion programming, by educating first offenders and parents to identify early warning signs of substance abuse/addiction. Obtaining further resources to assist in mental health diagnosis, including Multi Systemic Therapy, and Suicide prevention are continuing goals. Maintaining our Synergistic efforts with Schools and community partners will continue to be a priority. The Detention Center, operated under the Court is instrumental in identifying and changing attitudes of teens by implementing thoughtful and supportive correction programming. Continuing efforts to rehabilitate our kids as they re-enter the community is a significant challenge.

I will continue collaborating on programs like “Take Control” a Teen Driving Program. When the Court, Law Enforcement, family foundations and the Career Center combined efforts a 2.5 acre driving pad was constructed, where at no cost, under guidance from certified driving instructors, teen drivers may learn in classroom and on the track a skill set to drive safely.

I look to expand the Volunteer Guardian program to over 20 volunteers who can be trained to provide oversight and a human touch to those who may otherwise fall through the cracks. Having been the Administrative Judge over 60 employees, a practicing attorney throughout the State, and Presiding Judge of the Courthouse I am confident as to what features are needed in a new Courthouse facility what Case management and operational software ought be implemented. I have over 22 years experience as a judge in both the trial and appellate court levels. I’ve served as a judge in the Ohio Court of Appeals, 8th District, for over 17 years. I’ve authored over 1,400 lead opinions and have served on over 4,300 appellate panels. I’ve also handled numerous original action cases. I served for 5 years as a judge in Cleveland Municipal Court where I presided over 25,000 cases including more than 20 jury trials and 400 bench trials. I’ve also served as a visiting judge on the Supreme Court of Ohio.

(2) What about your non-judicial legal experience qualifies you to be a judge?
I served as an assistant County prosecutor in the Cuyahoga County Prosecutor’s Office from 1991-1998 where I tried and investigated numerous cases from murder to fraud including a period of service in the “white collar” Economic Crime Unit of that office. I also served as a trial court bailiff in Cuyahoga County Common Pleas Court from 1985-1991 where I managed the civil and criminal docket for Judge Donald C. Nugent while attending law school at night. I also served as a probation officer in Cuyahoga County from 1980 to 1984. I completed the A.S.T.A.R. course, at the Applied Science Technology Adjudication Resource Center, Washington D.C. (2007-2009) A two-year certification program offered through the Supreme Court of Ohio addressing the admission and/or exclusion of scientific evidence in American courts. Training included course study at Johns Hopkins University Medical School in Baltimore, Maryland. I was certified on April 17, 2009. I currently serve on the Ohio Sentencing Commission and previously served as the Chairman of the Commission on Practice and Procedures for Ohio Courts, (Supreme Court of Ohio) in 2008-2009. I’ve been active with the Ohio Judicial Conference: Criminal Law and Procedure Committee since 2001. I’ve served as presenter with the Supreme Court of Ohio Judicial College since 1998. I am also active with the Cleveland-Marshall College of Law Alumni Association (Life member) and I previously served as Editor of the former Cuyahoga County Bar Association’s, “Law and Fact,” magazine in 2005-2007. I am a past President of the Northern Ohio Municipal Judges Association, 2001-2002.

(3) Why are you running for this particular court seat?
I am running for re-election to continue my effort to provide a fair and balanced platform for the resolution of disputes in our community. I come from a humble, simple background. My first job in a courthouse was as a janitor cleaning floors. I was the first person in my family to graduate from college and go to law school. My parents were immigrants who worked to provide me the opportunity for a better life. I’ve worked my way up through the system. I’ve been involved at every level of the court system for more than forty years. I believe in its innate ability to ultimately offer hope and justice to all who appear in court. The best trait I offer is that I remember my humble origins and offer every attorney, litigant and colleague the promise that I will listen to each issue and balance the interests of those litigants within the context of the applicable law, regardless of any personal interests. I am not an activist judge. I try to apply the law to the facts of each case in a manner that is fair and balanced to all involved. I am humbled by the fact that I have been elected as a judge and have been afforded the great opportunity to serve and try to make our justice system better. I don’t take the responsibility lightly. I’ve dedicated myself to not only be a fair and impartial jurist, but also to work with professional entities to try to improve the judicial system. I believe my years of service have made me a better and more thoughtful judge. I’ve sat on a significant number of cases over my career in the court of appeals. I sincerely believe this experience will serve the court and the legal community in a positive way in my last term.

I have served as a judge on the Montgomery County Common Pleas Court, General Division, for eighteen years (2002-present) and have tried hundreds of jury trials involving a variety of criminal matters including murder cases, rape and sexual assault cases, theft, assault, weapons charges, and drug offenses, as well as civil trials involving such matters as medical malpractice, personal injury, contract disputes, landlord/tenant issues, tort actions, and other civil disputes. I have presided over the court’s Non-Support Court (2 years), Drug Court (4 years), and currently preside over the court’s Women’s Therapeutic Court. I served for three years as the court’s Administrative Judge. I recently served as the Chair of the Ohio Supreme Court’s Task Force to Examine Ohio’s Bail System. I frequently present continuing education programs to judges and lawyers and serve as a Trustee of the Ohio Judicial College.

Trial lawyer for 12 years serving families and businesses throughout the Miami Valley. Volunteer with the Greater Dayton Volunteer Lawyers Project representing members of the community who could not afford to hire a civil attorney. Mentor with the Ohio Supreme Court Lawyer to Lawyer Mentoring Program. Adjunct Professor at the University of Dayton School of Law for 16 years. Volunteer with numerous community organizations.

I have worked in this position for eighteen years and I am proud to have the privilege to serve the citizens of the community and the litigants who come before the court in timely and fairly providing adjudication of all matters for all who come before the court.

I was in private general practice of law for 31 years, working primarily in the areas of estate planning, tax, domestic relations, business, and real estate. In addition to my private practice, I was a part-time assistant prosecuting attorney for over 26 years with approximately 10 those years as a prosecutor in juvenile court. My experience in private practice, dealing especially with estate planning and domestic relations, created a strong foundation of real-life experiences with issues that a probate judge must handle.Likewise, my experience as a prosecutor in juvenile court where I prosecuted juvenile delinquency cases and neglect, abuse and/or dependency cases has provide me with valuable first hand experience with the type of cases I will hear as a judge.

(3) Why are you running for this particular court seat?
I am running for re-election to the Van Wert County Common Pleas Court, Juvenile/Probate Division because I love the job and during my tenure as judge I have run the court efficiently and effectively. For the past seven years and ten months, it is has been my honor to serve the people of Van Wert County as their juvenile and probate Judge. In juvenile court, the focus is predominately on what is in the best interest of the child.

Children are our most precious resource. It is extremely important that the juvenile judge be dedicated to do what is in the best interest of the child. When a child gets into trouble, my first goal is not to punish the child but to rehabilitate the child. To be sure, a child must be held accountable when he misbehaves. Sometimes, it is necessary to place a child in detention, but the most effective way to treat a delinquent child is through local treatment programs, supervised activities, and community services work with the goal to change the child’s behavior allowing them to become productive adults. When a child ordered to pay restitution, we provide the child with community service work which allows the child to generate money which is then paid to the victim as compensation for his or her economic loss. We have partnered with a local church for a garden project. The church has ground which they provide to our children on community control to raise vegetables for the community. This past year we had over 20 kids work in the garden. Many had no prior experience in growing, cultivating and harvesting vegetables from the garden. The harvest went to the local food pantry and the kids had a positive work experience.

By carefully utilizing our resources, the Juvenile Court has been able to spend less than what was originally allocated to the court in our budget, thereby allowing us to return to the Van Wert County general fund an average of 5,000.00 for each year of the last five years.

The other half of my job is Probate Court. This involves estates of people who have died, guardianships, adoptions, civil matters, records, trusteeships and other issues. In 2017, we placed our probate court records on line giving the community greater access to our information. In 2018, we placed marriage license application on line.
